The Supreme Court of Sri Lanka has ordered four officials from the Criminal Investigations Department (CID) and a complainant to pay compensation totalling Rs.425,000 over the violation of the Fundamental Rights of an individual related to a financial transaction.
According to Daily News, the decision was unanimously announced by the judge-bench comprising Buvaneka Aluvihare, A.H.M.D.Nawaz and Mahinda Samayawardena, when the petition filed by the Colombo 05 resident was taken up for hearing.
The petitioner claimed that his Fundamental Rights were violated by his arrest in 2019 based on a false complaint made regarding a personal financial transaction made for the import of two BMW cars.
Announcing that the CID officials had failed to follow proper protocol and investigate the falsity of the complaint, the judge-bench said the mechanism of justice should not be operated to fulfil the narrow goals of someone.
The court further ordered the complainant to pay Rs.300,000 as compensation to the victim.
Inspector M.M.J. Marasinghe, the OIC of the Special Investigation Unit of the Criminal Investigation Department, who made the arrest, was ordered to pay Rs.75,000.
Inspector A.S.Sudasinghe and Police Constable H.G.C.P. Priyadarshana were ordered to pay Rs. 25,000 each to the victim. (NewsWire)
